These Terms of Service (“Terms”) govern your access to and use of the ConsentSafe website, application, and related services available through consentsafe.app, app.consentsafe.app, and any related pages, features, or services we provide (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Eligibility

ConsentSafe is intended only for adults. By using the Service, you represent and warrant that you are at least 18 years old, legally able to use the Service, and legally capable of entering into these Terms. The Service is not intended for minors.

What ConsentSafe is

ConsentSafe is a privacy-first, mobile-first application designed to help two adults create a private, time-stamped, revocable Mutual Consent Agreement (“MCA”). ConsentSafe is intended to support clearer documentation and mutual participation. ConsentSafe does not guarantee outcomes, does not prevent disputes, and does not replace communication, judgment, or real-time consent. Consent can always be withdrawn by either party at any time.

ConsentSafe does not provide legal advice, law enforcement services, or professional legal representation. Nothing in the Service, website, FAQs, or other materials should be understood as legal advice. Your use of the Service does not create an attorney-client relationship with ConsentSafe or anyone associated with it.

ConsentSafe does not represent or warrant that an MCA is legally binding, legally enforceable, or sufficient for any particular legal purpose in any jurisdiction. The Service is a documentation tool, not a promise of legal protection or a guarantee against claims, investigations, disputes, or liability.

Account registration and access

Certain features of the Service require an account. You agree to provide accurate information when creating an account and to keep your information reasonably current. You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account, to the extent permitted by law.

The second participant in an MCA may receive limited access to a specific agreement through a secure email link. That limited access does not create a full user account unless otherwise stated by the Service.

How the Service works

ConsentSafe is designed so one participant starts an MCA and the second participant completes their part of the process on the same device. The guided flow may include agreement selections, activity selections, custom activity entries, duration selection, safe-word confirmation, signatures, and a required video step.

Once completed and saved, an MCA may become active for the selected duration unless it is revoked earlier. Either participant may revoke an active MCA independently. If an MCA expires or is revoked, it is no longer active going forward. If users want to continue or modify an agreement, they need to create a new versioned agreement.

User responsibilities

You agree to use the Service lawfully, truthfully, and only for its intended purpose. You are responsible for the information you enter into the Service and for your own decisions, conduct, and interactions with others.

You agree not to:

  • Use the Service in violation of any law or regulation.

  • Misrepresent your identity, age, or authority to use the Service.

  • Use the Service on behalf of another person without proper permission.

  • Submit false, misleading, abusive, unlawful, or infringing content.

  • Attempt to interfere with, disrupt, reverse engineer, scrape, or gain unauthorized access to the Service or its systems.

  • Use the Service to harass, exploit, threaten, or harm another person.

  • Use the Service in a way that suggests consent cannot be revoked or that the Service overrides real-time communication and conduct.

Payments, subscriptions, and billing

Some parts of the Service require payment. ConsentSafe currently offers paid plans, including one-time and subscription-based options. By purchasing a paid plan, you agree to pay the fees and any applicable taxes associated with your selected plan.

Payments are processed through third-party payment providers such as Stripe. ConsentSafe does not necessarily store full payment card details itself. Your payment transaction may also be subject to the terms and policies of the applicable payment provider.

If you enroll in a recurring subscription, you authorize recurring charges until you cancel in accordance with the applicable billing terms. Unless otherwise stated, subscriptions renew automatically until canceled.

Refunds, if any, are governed by our posted policies or applicable law. Unless otherwise required, refunds are not guaranteed.

Privacy

Your use of the Service is also subject to our Privacy Policy. Please review it carefully to understand how we collect, use, store, and disclose information.

Sensitive content and restricted access

ConsentSafe may store sensitive agreement-related information, including signatures and required video content. Stored media is encrypted and access-restricted. Stored videos are not available for general playback or download through the normal app experience.

ConsentSafe may disclose records only in limited circumstances, including when legally required or when released for legal purposes in accordance with applicable procedures and law.

Intellectual property

The Service, including its software, design, branding, text, graphics, logos, workflows, and related materials, is owned by ConsentSafe or its licensors and is protected by intellectual property and other applicable laws. These Terms do not transfer any ownership rights to you.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended personal use. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as allowed by law or with our written permission.

Service availability and changes

We may update, modify, suspend, or discontinue some or all of the Service at any time, with or without notice, to the extent permitted by law. We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

We may also update these Terms from time to time. When we do, we will post the updated version and revise the “Last updated” date. Continued use of the Service after an update may constitute acceptance of the revised Terms, to the extent permitted by law.

Suspension and termination

We may suspend, restrict, or terminate your access to the Service if we believe you have violated these Terms, used the Service unlawfully, created risk for us or others, or misused the Service in a way that is harmful, deceptive, abusive, or technically disruptive.

You may stop using the Service at any time. Termination of access does not necessarily require deletion of records that must be retained for legal, operational, security, billing, or evidentiary purposes.

Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. CONSENTSAFE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL MEET YOUR EXPECTATIONS OR ACHIEVE ANY PARTICULAR RESULT.

Without limiting the above, ConsentSafe does not warrant that:

  • any MCA will be legally valid or enforceable,

  • any user’s statements are truthful,

  • the Service will prevent disputes or accusations,

  • the Service will always be uninterrupted or error-free, or

  • the Service will be suitable for your specific legal, personal, or factual situation.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONSENTSAFE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, PARTNERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF CONSENTSAFE FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO CONSENTSAFE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100.

Some jurisdictions do not allow certain limitations or exclusions of liability, so some of the above may not apply to you.

Indemnification

You agree, to the extent permitted by law, to defend, indemnify, and hold harmless ConsentSafe and its owners, officers, employees, contractors, affiliates, partners, and service providers from and against claims, liabilities, damages, judgments, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Service, your violation of these Terms, your violation of law, or your violation of the rights of any person or entity.

Governing law and disputes

These Terms will be governed by the laws of the State of Oregon, without regard to conflict of law principles, unless applicable law requires otherwise. Any dispute arising out of or relating to these Terms or the Service will be brought in the appropriate state or federal courts located in Oregon, unless applicable law requires a different forum.

Severability and waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law. Our failure to enforce any provision is not a waiver of that provision or any other right.
